Terms and Conditions

This binding agreement contains all the Terms and conditions between 3G8 GLOBAL and the individual or organization (“You” or “Affiliate”) participating in the 3G8 GLOBAL Affiliate Program (“We”, “3G8 GLOBAL” or “the Program”). The agreement shall also apply to any beneficial party of 3G8 GLOBAL. By participating in the Program, you agree to be bound by the most current version of these Terms.

1. Rights and Obligations of 3G8 GLOBAL
1. Modification
   3G8 GLOBAL reserves the right to amend these Terms and conditions, at any time and at our sole discretion. The most current version of these Terms will be posted on the Program’s website. Also we will notify Affiliates by sending email to the email address which is provided by the Affiliate when they signed up for the Program. The amendment may include, for example: changes in the scope of available commission fees, fee schedules, payment procedures, and referral program rules. If any amendment is unacceptable to the Affiliate, your only recourse is to terminate this agreement according to term 5.1. Your continued participation in the program following our post of amendment notice or new agreement on our website will constitute binding acceptance of the change.
2. Member Registration and Tracking
   3G8 GLOBAL will accept the registration of referred members (“Customer”) and will track their play. By opening an account with 3G8 GLOBAL, the member agrees that all 3G8 GLOBAL general rules, policies and operating procedures will apply to them. 3G8 GLOBAL reserves the right to refuse members or terminate their accounts if necessary to comply with any requirements we may periodically establish. 3G8 GLOBAL reserves the right to review or re-verify the registration of referred member and, the right to require member to provide valid identity proof documents.
3. Commission Payment
   3G8 GLOBAL will pay Affiliate commission on a monthly basis.
2. Joining the Program
1. To join the Program, you shall submit a completed application form via the Affiliate website of 3G8 GLOBAL. We will evaluate the application and notify the potential affiliate of their acceptance or rejection to the program. 3G8 GLOBAL may reject any application if we determine, at our sole discretion, that the submitted website is unsuitable for the Program.
2. The Affiliate shall not open more than one Affiliate account without written consent from 3G8 GLOBAL. The Affiliate shall not, under the guise of another’s name, try to control more than one Affiliate account. In the event of a violation of this provision, 3G8 GLOBAL has the right to void all current and future play as well as eliminate any earned commissions applicable to such case.
3. You shall not bet on our website with your Affiliate account. If the Affiliate wants to bet through our member website, you should open an individual member account. 3G8 GLOBAL will offer our Affiliate a demo account to perform system test. In the event of violation of this provision, 3G8 GLOBAL has the right to revoke all commission earned by the Affiliate. In order to avoid the above situation, any individual member account registered through customer website will not be marked under any Affiliate line directly.
4. Sub-Affiliate is defined as any new Affiliate introduced by existing Affiliate partner.
3. Rights and Obligations of Affiliate
1. Linking to 3G8 GLOBAL Website
   By agreeing to take part in the Program, the Affiliate agrees to create and maintain a unique tracking link on their personal website which direct visitors to the official website of 3G8 GLOBAL. The tracking link can be linked with any banner of 3G8 GLOBAL website. This is the only method for Affiliate to promote us. 3G8 GLOBAL has the right to indicate the partnership relationship with Affiliate in the form of banners or buttons. The Affiliate, however, is not authorized the right to represent us.
2. Use of Marketing Materials
   In the event 3G8 GLOBAL designates any marketing materials as subject to particular restrictions (for example, campaign start/end dates, demographic limitations, etc.), you undertake and agree that you shall only use the marketing materials in accordance with such designated restrictions. You shall not modify any of the marketing material which is made available to you and that you will not, without our specific written approval, market or promote 3G8 GLOBAL using any promotional materials not provided or approved in writing by 3G8 GLOBAL.
3. Referral Commission
   Commission Calculations:

   1. 3G8 GLOBAL will pay the Affiliate a percentage of Net Profits from Sportsbook and Casino, generated by the referral members of the Affiliate.
   2. Commission is paid to the Affiliate after any operation/ marketing fees or others fees generated by the referral members is deducted from the Net Profits. The fees will be accumulated and be deducted from the monthly commission of Affiliate, such fees include:

   1. Banking Charge: includes all deposit or withdrawal handling fees generated by referred members.
   2. Marketing Fees: any operation fees for the use of marketing and promoting 3G8 GLOBAL.
   3. Promotional Fees: promotion bonus or other promotional cost given to referred members.
   4. Platform Fees: 10% of Net Loss of referred members:

   3. Minimum monthly commission payout amount is 500. If commission amount is less than 500, the commission will be accumulated to the following month.
   4. Affiliate must recruit at least 5 active members each month in order to get paid. A player with Minimum Monthly Bet of 100 or above qualifies as one active member.
   5. Commission will be paid once a month and it will be directly transferred to your 3G8 GLOBAL player account. The payment will be made within 10 working days after the last day of each month.
   6. Validation period of all pending commission is 90 days. Expired commission will be forfeited.
   7. If the Affiliate account is not active for more than 180 days, 3G8 GLOBAL has the right to freeze the account and cancelled all its earned commission without prior notice.
   8. Commission rate will be adjusted according to the performance of Affiliate.
   9. The Affiliate should have a valid platform to promote us. 3G8 GLOBAL reserves the right to delay any commission payment until the Affiliate can show supporting document.
   10. 3G8 GLOBAL, at its sole determination, reserves the right to cancel the Affiliate account and revoke all its commission earned if the Affiliate is suspected to have fraudulent behavior.
   11. 3G8 GLOBAL reserve the right to withhold any/all commissions generated during the probationary period (or any time thereafter) if Affiliate behavior is deemed to be fraudulent.
   12. 3G8 GLOBAL will monitor the performance of Affiliate regularly, if the performance of Affiliate is not satisfactory, 3G8 GLOBAL reserves the right to suspend or cancelled the Affiliate account.
4. Terms and Termination

These Terms will come into effect upon your submission of your registration to the Program and shall continue until your participation in the Program is terminated for any reason. Either party may terminate this Agreement for convenience at any time, effective upon written notice to the other. Any notice of termination shall be given in writing by either Party to the other. For purposes of notification of termination, delivery via e-mail is considered a written and immediate form of notification and the Terms shall accordingly terminate with immediate effect.

3G8 GLOBAL has the right to terminate any Affiliate account by below reasons:

1. Disapproval of application
2. Duplicated account
3. No contribution is 5 months
4. Fraudulent behavior

Upon termination, any balance in the Affiliate account will be forfeit. Affiliate should sign up for a new account if want to join the Program again.

In the event of termination of these Terms for any reason:

1. all rights and licenses granted to you in these Terms shall immediately terminate;
2. you must immediately cease all marketing activity, cease the distribution of any Marketing Materials, and disable any links from your Site to any 3G8 GLOBAL Site;
3. you must promptly return to us any Confidential information and/or customer information, and all copies of same in your possession, custody and control; and
4. for clarification purposes, termination will not exculpate you from any liability arising from any breach of these Terms, that occurred prior to termination.
5. Rebate

Affiliate shall not rebate any commission earned from the Affiliate Program to its members.

6. Relationship of Parties

3G8 GLOBAL and the Affiliate are independent contractors, and no terms in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. For the avoidance of doubt, the Affiliate has no authority to make or accept any offers or representations on behalf of 3G8 GLOBAL. The Affiliate agrees not to make any statement, whether on the Affiliate site or otherwise, that construes the Affiliate has a right to represent 3G8 GLOBAL.

7. Disclaimer

3G8 GLOBAL makes no express or implied warranties or representations with respect to the Affiliate Program, or referral fees and commission payment arrangements (including, without limitation, their functionality, warranties of fitness, merchantability, legality, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of our site or our customer’s sites will be uninterrupted or error-free and will not be liable for the consequences of any interruptions or errors.

8. Limitation of Liability

Except in the event of: (a) bodily injury or death caused by 3G8 GLOBAL’s negligence, or (b) any liability which cannot be excluded as a matter of law, 3G8 GLOBAL’s total and aggregate liability towards Affiliate or any third party, whether in an action based on contract, tort, warranty or any other legal theory, shall not exceed the amount of fees or Commissions generated by you during the twelve month period prior to the incident giving rise to liability, and (ii) in no event will 3G8 GLOBAL be liable toward Affiliate or any third party for any special, indirect, incidental, punitive or consequential damages, including but not limited to damages for loss of profits, business, revenue, or economic advantage.

9. Remedies

Our rights and remedies hereunder shall not be mutually exclusive, i.e., the exercise of one or more of the provisions of this Agreement shall not preclude the exercise of any other provision. You acknowledge, confirm, and agree that damages may be inadequate for a breach or a threatened breach of this Agreement and, in the event of a breach or threatened breach of any provision of this Agreement, the respective rights and obligations of the parties may be enforceable by specific performance, injunction, or other equitable remedy. Nothing contained in this Agreement shall limit or affect any of our rights at law, or otherwise, for a breach or threatened breach of any provision of this Agreement, it being the intent of this provision to make clear that our respective rights and obligations shall be enforceable in equity as well as at law or otherwise.

10. Severability/Waiver

Whenever possible, each provision of this Agreement shall be interpreted in such a manner as to be effective and valid under applicable law but, if any provision of this Agreement is held to be invalid, illegal or unenforceable in any respect, such provision will be ineffective only to the extent of such invalidity, or unenforceability, without invalidating the remainder of this Agreement or any provision hereof. No waiver will be implied from conduct or failure to enforce any rights and must be in writing to be effective.

11. Authoritative Version

If this Agreement is translated, the English language text shall prevail. Any other document provided in connection with this Agreement shall be in English or there shall be a properly prepared translation into English and the English translation shall prevail in the case of any conflict between them.
